These Terms & Conditions (“Terms”) govern your access to and use of younica.ca (the “Site”), as well as bookings made and services provided by Younica (“Younica”, “we”, “us”, “our”). By using the Site, booking an appointment, or receiving a service, you accept these Terms.
1. About Younica
Younica is an aesthetic clinic established in Quebec, Canada, offering services including laser hair removal (ND:YAG, Alexandrite), photo-rejuvenation, facials, lash extensions, and lash lifts. Service offerings and pricing may change without notice.
2. Eligibility
You must be at least 18 years old to book a service for yourself, or have the consent of a parent or legal guardian if you are a minor. By booking, you confirm that the information you provide is accurate and complete.
3. Bookings and consultations
Appointments may be booked online through our Square-powered booking system, by phone, or by email. We may refuse or cancel a booking if a treatment is contraindicated, if intake information is incomplete, or for any other safety or operational reason.
Before certain treatments (including laser hair removal), a consultation and/or patch test may be required. You must complete our intake form truthfully and disclose all relevant medical information.
4. Deposits, cancellations, and no-shows
• To cancel or reschedule, you must give at least 24 hours’ notice.
• Late cancellations (less than 24 hours’ notice) may be charged a fee equal to 50% of the booked service price.
• No-shows may be charged the full cost of the booked service.
• Arriving more than 15 minutes late may result in the appointment being shortened or rescheduled, at our discretion.
5. Pricing, taxes, and payment
Posted prices are in Canadian dollars and exclude applicable taxes (GST and QST). Payment is processed through Square (credit card, debit, or in-app payment). By providing payment information, you authorize us to charge the agreed amount, including applicable cancellation or no-show fees.
6. Gift cards, packages, and promotions
Gift cards and pre-paid packages are non-refundable and non-transferable unless required by law. Packages may have an expiry date indicated at the time of purchase. Promotions cannot be combined unless expressly stated.
7. Informed consent, risks, and results
Aesthetic treatments carry inherent risks, which may include — depending on the service — temporary redness, swelling, irritation, pigmentation changes, blistering, scarring, eye sensitivity, allergic reaction, or, rarely, more serious adverse effects. Before treatment, you will receive an explanation of these risks and you will be asked to sign a separate informed-consent form. You must follow all pre- and post-care instructions.
Results vary from person to person and depend on factors including skin type, hair type, hormonal context, lifestyle, and adherence to aftercare. No specific result is guaranteed.
8. Health disclosure
You must disclose all conditions, medications, supplements, recent treatments, sun exposure, and other circumstances that may affect treatment. We may refuse or postpone a service if we determine, in our reasonable judgment, that it would not be safe to proceed. Withholding relevant information may compromise your safety and may release Younica from liability for any resulting harm to the extent permitted by law.
9. Before/after photography
We may ask for your written consent to take before/after photos. You may decline, and you may withdraw your consent for future use at any time. Use of your photos is governed by the consent you signed and by our Privacy Policy.
10. Use of the Site
You agree to use the Site only for lawful purposes. You will not attempt to gain unauthorized access, interfere with the Site’s operation, or use automated tools to scrape it. Content on the Site (text, images, logos) is owned by Younica or its licensors and is protected by Canadian and international intellectual-property laws. You may not reproduce, distribute, or create derivative works from it without our prior written consent, except for personal, non-commercial use.
11. User submissions
If you submit content to the Site (for example, through a contact form, review, or social-media tag), you grant Younica a non-exclusive, royalty-free, worldwide license to use that content for the operation and promotion of its services. You represent that you own or have the rights to the content you submit.
12. Third-party services and links
The Site relies on third-party tools (including Square for booking and payments, and Google services). These tools have their own terms and privacy policies, and Younica is not responsible for them. The Site may also link to third-party websites; we do not endorse and are not responsible for their content.
13. Disclaimers
The Site is provided “as is” and “as available”. To the fullest extent permitted by law, Younica disclaims all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
The content on the Site is for general information only and does not constitute medical advice. For medical questions, consult a qualified health professional.
14. Limitation of liability
To the maximum extent permitted by applicable law, Younica, its owners, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Site or our services. Nothing in these Terms limits liability for gross negligence, intentional fault, or any liability that cannot be excluded by law.
15. Indemnification
You agree to indemnify and hold Younica harmless from any claim, damage, or expense (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) inaccurate or incomplete information you provided.
16. Governing law and jurisdiction
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute will be submitted to the exclusive jurisdiction of the courts of the district of Longueuil, Quebec, except where a consumer’s right to bring proceedings in their own forum is protected by law.
17. Language
The parties have expressly required that this agreement and all related documents be drawn up in English. Les parties ont expressément exigé que la présente convention et tous les documents qui s’y rattachent soient rédigés en anglais. A French version of these Terms is also available on the Site; in case of discrepancy, the French version prevails for clients located in Quebec, in accordance with applicable law.
18. Changes
We may modify these Terms at any time. The updated version takes effect when posted, with the new “Last updated” date. Continued use of the Site or services after that date constitutes acceptance.
